These Survey Terms and Conditions ("Terms") govern participation in the customer feedback survey (the "Survey") offered by Dress Barn Omni, Inc., d/b/a Dressbarn ("Dressbarn," "we," "us," or "our"). By completing the Survey, you ("you" or "Participant") agree to be bound by these Terms.

1. Eligibility

●         Participants must be legal residents of the United States and at least 18 years of age.

●         Participation is void where prohibited or restricted by applicable law.

●         Employees, contractors, and agents of Dressbarn and its affiliates, and their immediate family members, are not eligible to participate.

2. Ownership of Feedback

All responses, comments, suggestions, ratings, and any other content submitted through the Survey (collectively, "Feedback") shall become the sole and exclusive property of Dressbarn immediately upon submission. By submitting Feedback, you irrevocably assign to Dressbarn all right, title, and interest in and to the Feedback, including all associated intellectual property rights, worldwide and in perpetuity.

You waive any moral rights or similar rights you may have in the Feedback. Dressbarn may use, reproduce, modify, publish, distribute, and otherwise exploit the Feedback for any purpose, in any medium, without compensation, attribution, or further consent from you.

Dressbarn acquires no rights in you personally by virtue of this assignment; this clause concerns ownership of the Feedback only and does not create any employment, agency, or other relationship between you and Dressbarn.

3. Survey Coupon

●         Participants who complete the Survey will receive a coupon for $10.00 off  a future purchase (the "Coupon").

●         The Coupon expires six (6) months from the date of issuance and cannot be extended or reinstated after expiry.

●         Limit of one (1) Coupon per person, per email address, and per IP address, regardless of the number of Survey submissions made.

●         Dressbarn reserves the right to identify and reject duplicate, fraudulent, or automated Survey submissions, and to withhold or revoke a Coupon issued as a result of such submissions.

●         The Coupon is non-transferable, has no cash value, cannot be combined with other offers unless stated otherwise, and is subject to the standard terms of sale in effect at the time of redemption.

4. No Confidentiality

Feedback is not considered confidential or proprietary to you, and Dressbarn is under no obligation to treat it as such, except as required by applicable privacy law with respect to personal data.

5. Privacy

Any personal information collected through the Survey will be handled in accordance with Dressbarn's Privacy Policy. IP address and email address may be collected and retained solely to enforce the one-coupon-per-person limit described above and to prevent fraud.

6. Disclaimer

The Survey and any Coupon are provided "as is" without warranties of any kind. Dressbarn is not responsible for technical errors, lost submissions, or issues arising from third-party service providers used to administer the Survey.

7. Modification and Termination

Dressbarn reserves the right to modify, suspend, or terminate the Survey or these Terms at any time, without notice, for any reason.

8. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of such courts.

9. Entire Agreement

These Terms constitute the entire agreement between you and Dressbarn regarding the Survey and supersede any prior agreements or understandings, written or oral, relating to the Survey.
